General Binding Rules and your sewage system

If your property is not connected to the mains sewer, you are legally required to comply with the General Binding Rules set by the Environment Agency.

​

These regulations affect homeowners, landlords, developers, and businesses — especially when selling a property with a septic tank or sewage treatment plant.

Can You Sell a House with a Non-Compliant Septic Tank?
​

In short — no.​ Under current UK septic tank regulations:

​

  • You cannot sell a property with a septic tank that discharges directly into a watercourse.

  • All systems must meet the General Binding Rules.

  • Buyers’ solicitors now routinely check septic tank compliance.

  • Mortgage lenders may refuse to lend on properties with illegal or polluting systems.

Since January 2020, septic tanks that discharge to rivers, streams, or ditches must be upgraded to a compliant sewage treatment plant.

​

If your system does not comply, it must be upgraded before the property sale can complete.

​

What Are the General Binding Rules?

The General Binding Rules are government regulations that control small sewage discharges in England.

To be compliant, your system must:

​

  • Discharge to a properly designed drainage field or soakaway

  • Be correctly sized for the number of bedrooms or users

  • Be installed to manufacturer specifications

  • Be regularly serviced and maintained

  • Be emptied by a licensed waste carrier

  • Not cause pollution to groundwater or surface water

Environmental Agency (EA) Permit to Discharge
